(From Politico) U.S. Education Secretary Betsy DeVos is anticipated to roll out new federal standards for how colleges and K-12 schools handle sexual assault and harassment cases under Title IX. They would require colleges to hold a courtroom-like hearing where lawyers would cross-examine youthful witnesses and challenge their credibility — a huge shift from traditional behind-the-scenes investigations of highly sensitive and damaging allegations. The proposed rules allow but don’t mandate that elementary and high schools hold live hearings. They do require students to send formal, signed complaints to a narrow group of teachers or school employees to even investigate a potential Title IX violation, which has prompted concerns that young victims might report less frequently and that even well-resourced schools will be strained to hire staff and train existing employees.
