EEOC Favors Employee in Teleworking Accommodation Dispute

(from Venable) In summer 2020, a worker in Georgia with a lung condition requested her telework accommodation be extended when all employees were required to return to the office. The employer denied the request and then terminated her employment. This month, the EEOC filed a suit alleging that the employer failed to accommodate Ms. Moncrief's disability and retaliated against her for seeking a disability accommodation. One takeaway from the suit is that, according to the EEOC, telework may be here to stay for employees with qualifying disabilities. How can companies prepare? Review and edit job descriptions, teleworking policies and accommodation procedures among other measures.
