Trump's “Executive Order on Promoting Free Speech and Religious Liberty,” issued on Thursday, May 4, mandates that the IRS not enforce the Johnson Amendment, which forbids tax-exempt religious nonprofits from engaging in political campaigns, endorsing candidates or making political contributions. Some argue that the EO violates the Constitution by enabling religious nonprofits to engage in politics and therefore favoring religious nonprofits over secular ones. The EO also stipulates that religious organizations do not have to comply with ACA regulations, but such organizations are already exempt. Parochial schools may feel an impact, but non-religious independent schools will not be affected.
