Federal Agencies Urge Caution on AI-based Discrimination

May 2, 2023, 3:00 PM

(From National Law Review) Leaders from four federal agencies issued a joint statement last week on the use of artificial intelligence and automated systems, outlining how existing U.S. laws and regulations apply to these technologies. The agencies outlined three potential sources of discrimination within automated systems:

  • Data and datasets.
  • Model opacity and access.
  • Design and use.

Employers using or considering using automated systems for employment related purposes should view the Joint Statement to ensure that they do not discriminate against employees based on their legally protected characteristics or status.
