(From SHRM) The U.S. Supreme Court’s recent ruling in the case of Starbucks vs. McKinney may give HR professionals more confidence in terminating employees for serious policy violations, even if they are union organizers. While the case has been sent back to lower courts to apply stricter standards for Section 10(j) injunctions, it signals that proper documentation of policy violations remains crucial. This ruling could reduce the likelihood of employees being reinstated unless there is a strong case, according to attorney Amy Moor Gaylord. HR professionals should ensure policies are enforced uniformly, maintain detailed records and align with labor laws to avoid unfair labor practice claims.
