Oct 27, 2021, 12:21 PM

(from Venable) Recently, the IRS issued guidance to clarify how the Emergency Relief Period, which was initiated during the COVID-19 emergency, applies to the deadline for making an initial COBRA premium payment. The guidance also provides transition relief, allowing certain individuals to make their first COBRA premium payment later than the otherwise-applicable deadline, so long as the payment is made on or before November 1, 2021. The guidance covers the following topics:

  • When the emergency relief period begins and ends
  • How the emergency relief period affects COBRA deadlines
  • Electing and paying for COBRA
  • Transition relief
  • COBRA premium assistance under the American Rescue Plan Act (ARPA)
