(from CUPA HR) The Department of Labor's Wage and Hour Division has issued a fact sheet clarifying certain issues with respect to how the "white collar" exemptions to federal overtime pay requirements apply to teaching and other common jobs in higher education. A notable finding in "Fact Sheet #17S: Higher Education Institutions and Overtime Pay Under the Fair Labor Standards Act" is the applicability of the teaching exemption to faculty members who teach online or remotely, as well as coaches, among others. The fact sheet also clarifies and explains the specific regulatory provisions for the special exemption, with a potentially reduced salary level, for "academic administrative personnel."
It is unclear at this time how much of this clarification translates directly to K-12 independent schools.
